MAKI Values ​​Termination of Investigation of Invalid Lili Gratification Allegation

The Indonesian Anti-Corruption Society Coalition (MAKI) considers that the termination of the investigation into the alleged gratification case of Lili Pintauli Siregar in the form of accommodation and tickets to watch MotoGP Mandalika from PT Pertamina (Persero) is illegal.

This was revealed in the MAKI pretrial application file against the Corruption Eradication Commission (KPK) as respondent I and the KPK supervisory board (Dewas) as respondent II regarding whether or not the termination of the investigation into Lili Pintauli was legal. The first trial was held on Monday (27/3) and continued on Tuesday (28/3) with the agenda for the response of the KPK and the KPK Council.

“That the actions of the defendants who did not forward the settlement of the case to the prosecution, to the corruption court, were a form of ending an illegal investigation, so it was naturally null and void,” according to MAKI’s pretrial application file quoted, Tuesday.

In the file it was explained that the KPK Dewas had examined Lili Pintauli who allegedly received a number of movie ticket facilities and lodging for approximately one week to watch the MotoGP match in Mandalika.

Apart from that, the KPK Board of Trustees has also examined the Main Director of PT Pertamina Nicke Widyawati for providing facilities to Lili Pintauli.

According to MAKI, the provision of this facility was carried out when the KPK was conducting an investigation into the criminal act of liquid natural gas (LNG) corruption that occurred in the body of a subsidiary of PT Pertamina which was previously handled by the Attorney General’s Office.

MAKI assesses that the provision of facilities to Lili Pintauli is part of a form of gratuity and should be suspected of leading to a form of bribery.

“Thus, the settlement should not be solely resolved by Respondent I through ethical or administrative decisions,” they said.

MAKI said that the KPK Board of Trustees should delegate cases and investigations to KPK investigators for investigations and filing processes and be resolved through the criminal justice mechanism.

This is what the Corruption Eradication Committee did for other state officials who received gifts from the private sector, related to the position or position of the said state official.

However, Lili Pintauli then submitted a letter of resignation to President Joko Widodo before the KPK Board of Trustees made a decision.

“As a result, the case stopped without any decision being made regarding what was done by Lili Pintauli Siregar and PT Pertamina,” said MAKI.

MAKI previously filed a lawsuit which questioned Lili Pintauli Siregar’s alleged gratification. The lawsuit was registered by MAKI on Wednesday, 22 February 2023.

They asked the panel of judges to legally state that the Corruption Eradication Committee had taken action to terminate the investigation illegally according to law into the alleged corruption case in granting facilities to Lili.

MAKI also asked the panel of judges to order the KPK to carry out further legal proceedings in accordance with applicable legal provisions and laws and regulations, namely to immediately conduct an investigation into the alleged corruption case in granting facilities to Lili.
