KontraS Coordinator Fatia Maulidiyanti said that the discourse on the formation of a non-judicial Human Rights Violation Settlement Team (PPHAM) has sparked a polemic in the community. The reasons for this include hasty writing of material, not being open to the public, and the entry of names without confirmation. Therefore, Fatia regrets that the government has approved the Presidential Decree for the Establishment of a Non-Judicial Human Rights Violation Settlement Team.
“Recently, KontraS received a policy paper containing PPHAM which was signed by the State Secretariat on August 26, 2022,” said Fatia to VOA, Friday (23/9/2022).
Fatia added that there were a number of irregularities in the documents circulating in the public. This is because KontraS has asked three state institutions, namely the State Secretariat, Kemenkopolhukam, and Kemenkumham to ensure information regarding the Presidential Decree on PPHAM. However, there is no clarity regarding this information until September 16, 2022.
“However, on September 20, 2022, we received information that the Presidential Decree had been signed by the State Secretariat since August 26, 2022, exactly two days after our request for information was officially received by the State Secretariat.”
Based on these conditions, he concluded, there were indications that the government had deliberately covered up the document. According to him, the secrecy of the information further emphasizes that the government is taking shortcuts so that it is judged to have resolved gross human rights violations.
Plus, said Fatia, there is the name of Kiki Syahnakri as a member of the Implementing Team. In fact, in 1995, said Fatia, Kiki was once suspected of being responsible for the killings of residents of Liquica, Timor Leste, by members of the TNI.
The choice of perpetrators of gross human rights violations as members of the Implementing Team confirms the thick wall of impunity built by the state.”
VOA has tried to contact Deputy V of the Presidential Chief of Staff (KSP) Jaleswari Pramodhawardani regarding this. However, there has been no response until this news was revealed.
This week, documents circulated about the Presidential Decree on the Formation of a Non-Judicial Team signed by the Ministry of State Secretariat on August 26, 2022. The Presidential Decree contains the formation of the PPHAM Team which is located under, and responsible for, the president.
This team has three tasks, namely non-judicial settlement, recommendations for recovery of victims and their families, and prevention of gross human rights violations. This team is chaired by Makarim Wibisono, Deputy Chairperson Ifdhal Kasim, and a number of members such as Harkristuti Harkrisnowo and Kiki Syahnakri.
The formation of the PPHAM Team is also like the State Speech delivered by President Joko Widodo at the Indonesian House of Representatives in August 2022. At that time, Jokowi said that the resolution of past gross human rights violations continued to be the government’s concern.
“The Truth and Reconciliation Commission Bill is in the process of being discussed. The follow-up to Komnas HAM’s findings is still ongoing.
